1. Oggetto e accettazione

Il presente accordo regola la concessione di una licenza d'uso personale, non esclusiva e non trasferibile del Software al Licenziatario (di seguito "Utente"). Acquistando, scaricando, installando o utilizzando il Software, l'Utente dichiara di aver letto, compreso e accettato integralmente i presenti termini.

2. Concessione di licenza

L'Autore concede all'Utente una licenza personale, perpetua (fino a revoca per violazione), non esclusiva e non trasferibile per:

installare il Software su dispositivi di proprietà o nell'uso esclusivo dell'Utente;
utilizzare il Software per finalità di calcolo eventi per attività personali o professionali proprie dell'Utente.

3. Limiti d'uso — cosa NON è consentito

L'Utente NON è autorizzato a:

copiare, duplicare, ridistribuire, vendere, sublicenziare o regalare il Software o le sue parti, in forma totale o parziale;
pubblicare il codice sorgente, in chiaro o offuscato, su qualsiasi piattaforma pubblica o privata;
condividere la propria License Key, le credenziali d'accesso o il link privato di download con soggetti terzi;
effettuare reverse engineering, decompilazione o disassemblaggio del Software al fine di ricavarne il codice sorgente non distribuito;
utilizzare il Software come componente di prodotti destinati alla rivendita white-label o a servizi commerciali rivolti a terzi;
rimuovere, modificare od oscurare le note di copyright, i marchi o gli identificativi della licenza presenti nel codice.

4. License Key e attivazione

L'attivazione del Software è subordinata all'inserimento di una License Key personale fornita all'Utente al momento dell'acquisto. La License Key:

è personale, univoca e legata all'identità dell'Utente;
può essere attivata su un numero limitato di dispositivi indicato in fase di vendita;
può essere revocata dall'Autore in caso di violazione del presente accordo, condivisione abusiva o sospetta frode.

5. Proprietà intellettuale

Tutti i diritti, titoli e interessi sul Software, sul codice sorgente, sul design, sulle interfacce, sui database delle ricette, sui contenuti editoriali, sulle traduzioni e sugli asset grafici rimangono di proprietà esclusiva dell'Autore. Il presente accordo non trasferisce alcun diritto di proprietà intellettuale all'Utente; concede esclusivamente un diritto d'uso secondo i termini sopra descritti.

Il documento PDF "Cocktail IBA · Adattamento per Feste" è soggetto a licenza separata Creative Commons BY-NC-ND 4.0. Le ricette IBA citate sono di proprietà dell'International Bartenders Association.

6. Aggiornamenti e supporto

L'Autore non è obbligato a fornire aggiornamenti o supporto tecnico. Eventuali aggiornamenti gratuiti, quando rilasciati, sono offerti a discrezione dell'Autore e soggetti agli stessi termini di questa licenza.

7. Garanzie e limitazione di responsabilità

Il Software è fornito "così com'è", senza garanzie esplicite o implicite di alcun tipo, comprese ma non limitate a garanzie di commerciabilità, idoneità a uno scopo particolare e non violazione. L'Autore non potrà essere ritenuto responsabile per:

danni diretti, indiretti, incidentali, speciali o consequenziali derivanti dall'uso o dall'impossibilità d'uso del Software;
errori di calcolo, omissioni o discrepanze tra le previsioni dell'app e i consumi reali durante eventi reali;
conseguenze derivanti dal consumo di bevande alcoliche da parte di terzi.

La responsabilità massima dell'Autore non potrà in ogni caso eccedere il prezzo pagato dall'Utente per la licenza.

8. Diritto di recesso

Trattandosi di contenuto digitale fornito in formato non tangibile, il diritto di recesso di 14 giorni previsto dal Codice del Consumo (D.Lgs. 206/2005) viene meno con l'inizio dell'esecuzione (download o attivazione della License Key), come consentito dall'art. 59, lett. o). L'Utente accetta espressamente questa condizione al momento dell'acquisto. La gestione di eventuali rimborsi è curata dal Merchant of Record Lemon Squeezy secondo le sue policy.

9. Risoluzione

La licenza si risolve automaticamente in caso di violazione di una qualunque delle clausole sopra descritte. In caso di risoluzione, l'Utente è tenuto a disinstallare immediatamente il Software e a distruggere ogni copia, inclusi backup. La License Key associata sarà revocata. Le clausole 3, 5, 7 e 11 sopravvivono alla risoluzione.

10. Privacy

Il trattamento dei dati personali è disciplinato dalla Privacy Policy separata.

11. Legge applicabile e foro competente

Il presente accordo è regolato dalla legge italiana. Per qualsiasi controversia derivante o connessa al presente accordo, il foro competente è quello del luogo di residenza del consumatore, ai sensi del Codice del Consumo.

1. Subject and acceptance

This agreement governs the grant of a personal, non-exclusive and non-transferable license to use the Software to the licensee (the "User"). By purchasing, downloading, installing, or using the Software, the User acknowledges having read, understood, and fully accepted these terms.

2. License grant

The Author grants the User a personal, perpetual (subject to revocation for breach), non-exclusive, and non-transferable license to:

install the Software on devices owned by or under the exclusive use of the User;
use the Software for event-calculation purposes related to the User's personal or professional activities.

3. Usage restrictions — what is NOT permitted

The User is NOT authorized to:

copy, duplicate, redistribute, sell, sublicense, or give away the Software or any portion thereof;
publish the source code, in plain or obfuscated form, on any public or private platform;
share their License Key, access credentials, or private download link with third parties;
reverse engineer, decompile, or disassemble the Software to derive non-distributed source code;
use the Software as a component of products intended for white-label resale or commercial services offered to third parties;
remove, modify, or obscure copyright notices, trademarks, or license identifiers contained in the code.

4. License Key and activation

Software activation requires entering a personal License Key provided to the User at the time of purchase. The License Key:

is personal, unique, and linked to the User's identity;
may be activated on a limited number of devices specified at the time of sale;
may be revoked by the Author in case of breach of this agreement, abusive sharing, or suspected fraud.

5. Intellectual property

All rights, title, and interest in the Software, source code, design, interfaces, recipe databases, editorial content, translations, and graphic assets remain the exclusive property of the Author. This agreement does not transfer any intellectual property rights to the User; it grants only a usage right under the terms described above.

The PDF document "IBA Cocktails · Party Adaptation" is subject to a separate Creative Commons BY-NC-ND 4.0 license. The IBA recipes referenced are the property of the International Bartenders Association.

6. Updates and support

The Author is not obliged to provide updates or technical support. Any free updates, when released, are offered at the Author's discretion and subject to the same terms of this license.

7. Warranties and limitation of liability

The Software is provided "as is", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Author shall not be held liable for:

direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Software;
calculation errors, omissions, or discrepancies between the app's forecasts and actual consumption at real events;
consequences arising from the consumption of alcoholic beverages by third parties.

The Author's maximum liability shall in no case exceed the price paid by the User for the license.

8. Right of withdrawal

As digital content provided in intangible form, the 14-day right of withdrawal otherwise granted by EU consumer law is waived upon commencement of performance (download or License Key activation), as permitted by EU Directive 2011/83 article 16(m). The User expressly accepts this condition at the time of purchase. Refunds, where applicable, are managed by Merchant of Record Lemon Squeezy according to their policy.

9. Termination

The license is automatically terminated in case of breach of any of the clauses above. Upon termination, the User must immediately uninstall the Software and destroy all copies, including backups. The associated License Key will be revoked. Clauses 3, 5, 7, and 11 survive termination.

10. Privacy

The processing of personal data is governed by the separate Privacy Policy.

11. Governing law and jurisdiction

This agreement is governed by Italian law. Any dispute arising from or related to this agreement shall be subject to the competent court of the consumer's place of residence, in accordance with EU consumer law.
